Class action settlement claim rates have always been hard to track, and with email notices and electronic filings, the rates have increased but so have the costs. But with generative AI may come answers on how to better improve the need to perform massive dataset gathering and filtration.

"It runs AI across data sets to generate claims, they say," Weaver said. "This is problematic in a number of ways because what you have then are communications that are not approved by the court being sent out to solicit participation, which could be duplicative, which could be fake."
